Terms of Service

These Terms of Service ("Terms") govern your use of the OfferQuest Chrome extension, web dashboard, and related services (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old and legally capable of entering into a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use at support@offerquest.app. We may suspend or terminate accounts that violate these Terms.

3. Subscriptions, billing, and refunds

• Free plan: includes up to 5 AI generations per rolling 24-hour window. No payment required.
• Pro plans: billed monthly or every 3 months in advance via Stripe. Monthly plans auto-renew every month; 3-month plans auto-renew every 3 months. You authorize us to charge your payment method at the start of each billing period.
• Cancellation: you may cancel at any time through the Stripe Customer Portal (accessible via the "Manage billing" button in Settings or on your dashboard). On cancellation, Pro features remain active until the end of the current billing period.
• Refunds: monthly subscriptions are non-refundable. 3-month subscriptions may be refunded on a prorated basis within the first 14 days of the initial term. Email support@offerquest.app to request a refund.
• Price changes: we may change prices with 30 days' notice. Existing subscribers keep their current price until their next renewal.
• Failed payments: if a payment fails, we will retry according to Stripe's default schedule. If all retries fail, the subscription will lapse and your account will revert to the Free plan.

4. Acceptable use

You agree not to:

• Use the Service to create fraudulent, misleading, or plagiarized content.
• Submit job descriptions or experience data that infringe on intellectual property.
• Reverse engineer, decompile, or attempt to extract the source code of our backend.
• Use automated tools to abuse the free tier or bypass rate limits.
• Resell, sublicense, or redistribute the Service without permission.
• Use the Service for anything unlawful, harmful, or discriminatory.

We reserve the right to suspend or terminate any account that violates these restrictions.

5. Intellectual property

• Your content: you retain ownership of all data you provide (career history, resumes, applications, etc.) and all content we generate for you. By using the Service, you grant us a limited license to process that content solely for the purpose of providing the Service.
• Our product: the OfferQuest name, logo, code, and documentation are our intellectual property. You may not copy, modify, or distribute them without permission.

6. AI-generated content disclaimer

OfferQuest uses large language models (Anthropic Claude) to generate content. AI output can contain inaccuracies, omissions, or hallucinations. You are responsible for reviewing every document before submitting it to an employer. We make no guarantee that using OfferQuest will result in a job offer, interview, or any specific outcome.

7. Third-party services

The Service depends on Anthropic, Supabase, Stripe, Vercel, and Google OAuth (if used). Your use of those services is also governed by their respective terms. We are not responsible for outages or failures originating from third-party providers.

8. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OFFERQUEST'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

9. Termination

You may terminate your account at any time by emailing support@offerquest.app. We may terminate or suspend your access to the Service at any time, with or without notice, for conduct that violates these Terms. Upon termination, your right to use the Service ends immediately.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced via email and the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which OfferQuest is incorporated, without regard to its conflict of laws rules. Any dispute will be resolved in the courts of that jurisdiction.
